LifeArc User Agreement

Welcome to LifeArc! These Terms of Service ("Terms") govern your access to and use of the LifeArc mobile application and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the LifeArc Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and LifeArc.

2. Eligibility

You must be at least 13 years old to use the LifeArc Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

3. Your Account

• You may need to register for an account to use certain features of the Service.
• You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account.
• You agree to notify LifeArc immediately of any unauthorized use, or suspected unauthorized use of your account or any other breach of security.
• LifeArc cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

4. Use of the Service

• Personal Use: The Service is intended for your personal, non-commercial use only.
• Accurate Information: You agree to provide accurate, current, and complete information as may be requested by LifeArc.
• No Medical Advice: The information provided by LifeArc is for informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
• Prohibited Conduct: You agree not to:
  • Use the Service for any illegal purpose or in violation of any local, national, or international law.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorized access to the Service or its related systems or networks.
  • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
  • Collect or harvest any personally identifiable information from the Service without express written permission.

5. Intellectual Property

All content, features, and functionality within the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of LifeArc or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6. User Content

• You retain ownership of any health data or other content you submit, post, or display on or through the Service ("User Content").
• By submitting User Content, you grant LifeArc a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute such User Content in connection with the Service.
• You are solely responsible for your User Content and the consequences of posting or publishing it.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LIFEARC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LIFEARC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIFEARC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

9. Indemnification

You agree to defend, indemnify, and hold harmless LifeArc and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) User Content posted on the Service.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of **Hong Kong Special Administrative Region**, without regard to its conflict of law provisions.

Any dispute, controversy, difference, or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach, or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it, shall be referred to and finally resolved by the courts of **Hong Kong Special Administrative Region**.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
